Joule NV is committed to protecting your privacy and takes its responsibilities regarding the security of personal customer data very seriously. 1. Scope of application

As used in this Privacy Policy, the terms “use” and “process” of Personal Data (as defined below) include subjecting the Personal Information to statistical or other analyses and using or processing Personal Information in any way whatsoever, including, but not limited to, collection, storage, evaluation, modification, deletion, use, combination, disclosure and transfer as detailed in this Privacy Policy .

Joule (" we " or " us ") provides this Policy to inform you of our policies and procedures regarding the collection, use and disclosure of Personal Data of anyone who uses the Website and the Services offered thereon (the " Users " or " you ").


2. What information do we collect?

Joule collects and processes two types of information: (i) information that Users provide to us and (ii) information relating to the User's use of the Website (collectively, the " Personal Data "). Personal Data shall have the meaning ascribed to it in applicable Belgian and European law.

(i) Information you provide to us:

When you visit the Website, send us an email or communicate with our customer service, you voluntarily provide us with certain Personal Data that we collect and process. Such Personal Information may include, but is not limited to, your name, date of birth, physical address, telephone number or email address. Should you provide us with information about another person, you hereby confirm that you fully respect the GDPR and that you have received all necessary consents to do so.

Additionally, when you contact our customer service or a Joule representative, when you provide us with feedback or when you participate in a promotion, we may keep a record of that correspondence and collect information necessary to classify your inquiry/participation, respond to it and, if applicable, investigate a possible violation of this Privacy Policy .

(ii) Information we learn about you from your use of the Website:

We may collect or process your IP address and certain non-personal information or aggregated data about how and when you use the Website. This information is typically of a technical nature ( device settings and information, including but not limited to browser type, operating system, keyboard language, screen resolution, IP address, location, etc.) and behavioral nature (the actions you take on the Website, including but not limited to access times, pages requested, actions taken, etc.) and is used to compile statistical data about the use of our Website.


3. Purposes of collecting information

Joule collects Personal Data solely for the following purposes:

i. Compliance with legal obligations (Art. 6, §1, c) of the GDPR):

We may also process your Personal Data to comply with the law, to complete any legally required documentation in any country/region where the User or Joule operates or in case of illegal use, when we receive orders from judicial authorities.

We may also monitor your compliance with your obligations as set out in our Policy and investigate fraud and violations of any applicable rules and regulations.

ii. Legitimate interests (Art. 6, §1, f) of the GDPR):

In addition to collecting your Personal Data to provide our services or to comply with legal obligations, we may collect and use your Personal Data for the following purposes:

a. Improving the user experience:

By tracking your use of the Website, we can personalize our services and you can use the Website properly. This also allows us to learn more about User preferences and general trends on the Website in order to improve the quality of the Website and personalize your experience.

b. Provide customer service:

We take care of general customer administration by answering your questions, handling your requests and solving any problems that may arise.

c. Carrying out marketing campaigns:

We may contact you with tailored suggestions and information about events and other products or services, as well as communications about the Website and/or Joule.

You may choose to unsubscribe from Joule marketing promotions and/or Joule postal/email correspondence at any time if you no longer wish your Personal Data to be used for any of the above purposes. If you no longer wish to receive commercial communications from us, you may choose to unsubscribe from such commercial communications at any time by sending us an email at hello@joule.be

d. Generate statistics and perform statistical analyses:

We may generate anonymous statistics about (the use and users of) the Website in order to improve it and perform statistical analyses.

e. Sharing anonymous information with third parties:

Some of your Personal Data may be disclosed to other companies in our group of companies to improve our services (for example, to D'Ieteren Automotive NV, or to other affiliated companies). No Personal Data will ever be disclosed to third parties for marketing, advertising and promotional purposes. Only anonymous information may be disclosed to third parties for marketing, advertising and promotional purposes and for statistical purposes for mobility trends.

If you would like to know in more detail to which third parties your Personal Data has been provided and which Personal Data has been disclosed, please refer to section 6 below (“your rights”).

f. Performing our services in the context of bicycle leasing, bicycle purchasing and related services:

If you wish to conclude a bicycle lease, bicycle purchase or related services with Joule, we request Personal Data in order to correctly execute our contract, including the delivery, maintenance and repair of bicycles, checking the correct size and concluding the contract for insurance and breakdown assistance and the collection of bicycles by Joule or subcontractors.

iii. Other processing:

We will always ask your consent before using Personal Data for purposes other than the purposes set out in this Policy.


4. Security of your Personal Data

To prevent the loss, misuse and alteration of your Personal Data, Joule has implemented a variety of appropriate technical and organizational security measures that meet or exceed industry standard technologies to protect the confidentiality of your Personal Data and ensure your online security. However, Joule cannot guarantee that unauthorized access will never occur.

Joule makes every effort to protect the confidentiality and security of your Personal Data.

In the event of a breach of your Personal Data, Joule undertakes to notify the Data Protection Authority without delay, and if possible at the latest within 72 hours of becoming aware of the breach.

Joule is in no way liable for direct or indirect damage resulting from incorrect or unlawful treatment by third parties.


5. Data retention period

We will not process your Personal Data for longer than is necessary for the purposes set out in this Policy: we will retain your Personal Data for as long as the processing of your Personal Data is necessary to enable you to use our Website. Your Personal Data will be deleted or anonymised after a period of maximum three years after our last exchange or for a longer period when we are legally required to do so.


6. Your rights

The exercise of your rights is free of charge and can be done at any time, provided that this is legally permitted. If and to the extent provided for in the applicable Belgian and European legislation, you have the right:

a) to obtain from Joule confirmation as to whether or not your Personal Data are being processed and, where that is the case, you have the right to access the Personal Data undergoing processing;

b) to obtain from Joule without delay the rectification of incorrect or incomplete Personal Data;

c) to obtain from Joule the erasure of Personal Data;

d) to obtain from Joule the restriction of the processing of your Personal Data;

receive the Personal Data in a structured, commonly used, machine-readable format and to have such Personal Data transmitted;

f) object to the processing of your Personal Data and object at any time and without giving reasons to the processing of your Personal Data and/or to the transfer of your Personal Data to third parties.

These rights can be exercised by sending an email to hello@joule.be or by sending a letter to Joule, Rooigemlaan 455, 9000 Ghent.

If you consider that the processing of your Personal Data infringes applicable law, you have the right to lodge a complaint with the supervisory authority (the Data Protection Authority) by sending an email to contact@apd-gba.be or to any other email address provided by the competent supervisory authority ( https://www.dataprotectionauthority.be ).


7. Changes to this policy

We reserve the right to change this Privacy Policy at any time. Any changes to the Policy will be posted on the Website. In the event of material changes to the Policy that result in Joule using your Personal Data in a manner materially different from that stated at the time of collection, we will provide you with a specific notice on the Website and/or send you an email notification.


8. Legislation and competent courts

This Privacy Policy shall be governed by and construed in accordance with Belgian law, which shall apply exclusively to any dispute arising therefrom.

Any dispute arising out of or in connection with this Privacy Policy shall be settled exclusively by the competent courts of Brussels, Belgium.
